On April 14, 2011 around 11:20 pm in Seattle, WA, an employee of a power equipment company was sleeping in the store. The company had been robbed six previous times. The employee awoke to the sound of glass breaking and grabbed his legally permitted .357 revolver and moved to investigate. He encountered James Stapleton, a convicted felon who had already killed a man in Georgia and released, carrying several chainsaws toward the door. The employee pointed his gun and told Stapleton not to move. Stapleton shifted the weight of the saws to his left shoulder as he reached into his waistband with his right hand. The employee, fearing that he was about to pull out his own gun and shoot him, fired one round, striking Stapleton in the head and likely killing him instantly. He dialed 911 to report the incident as he held Stapleton's accomplice, Andrew Sidden, another repeat felon with convictions in Florida, Hawaii, California, and Idaho, at gunpoint.

No one else was injured in the incident; police have not revealed the victim's name since it was a justified use of force and he will not be charged. Sidden plead guilty five months later for his role in the burglary.
